Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Diamond DAW software, website, and related services (the “Software”), provided by [Your legal name or company] (“we”, “us”). By installing or using the Software, or by purchasing a license, you agree to these Terms. If you don't agree, don't use the Software.
License grant
Subject to these Terms and your active plan, we grant you a personal, non-exclusive, non-transferable license to install and use the Software on computers you own or control. We offer three ways to license Diamond DAW:
- Subscription — access continues while your subscription is active and ends when it lapses or is cancelled.
- Rent-to-Own — you pay monthly and retain full access while payments are current; after the final scheduled payment, your license converts to a perpetual license and no further charges are made.
- One-Time Purchase — a perpetual license to the version range described at checkout, including updates for the period stated there.
Restrictions
You agree not to:
- copy, resell, sublicense, rent, or redistribute the Software or your license keys;
- reverse engineer, decompile, or attempt to extract source code, except where that restriction is prohibited by law;
- circumvent license activation, trial limits, or usage controls;
- use the Software unlawfully or to infringe others' rights.
Trial
We may offer a time-limited free trial. Trial access ends automatically when the trial period expires unless you purchase a plan.
Payment & billing
Purchases and subscriptions are sold and fulfilled through our third-party merchant of record, who is the seller of record for your transaction and handles billing, invoicing, and applicable taxes. Subscriptions and rent-to-own plans renew automatically at the stated interval until cancelled. Prices are shown at checkout and may change for future billing periods with notice.
Refunds & cancellation
You can cancel a subscription or rent-to-own plan at any time; access continues through the period you've paid for. One-time purchases include the money-back guarantee described on our pricing page. Refunds are processed by our merchant of record in line with that policy.
Updates
We may release updates, and may modify or discontinue features over time. Which updates you are entitled to depends on your plan as described at purchase.
Intellectual property
The Software and all related intellectual property remain ours. Music and projects you create with the Software are yours.
Disclaimer & limitation of liability
The Software is provided “as is” without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, our aggregate liability arising from or relating to the Software is limited to the amount you paid for it in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
Termination
We may suspend or terminate your license if you materially breach these Terms. On termination, you must stop using the Software. Perpetual-license rights granted before termination survive unless terminated for breach.
Governing law
These Terms are governed by the laws of [your jurisdiction], without regard to conflict of law rules, and the courts of [your jurisdiction] have exclusive jurisdiction, except where mandatory consumer law provides otherwise.
